  • What is a trademark?
    A trademark is a sign capable of distinguishing the goods or services of one undertaking from those of other undertakings; and of being represented in the trademark register in such a way as to enable the competent administrative or judicial authorities and the public to determine clearly and unequivocally the subject-matter of the protection conferred on its proprietor. Trademarks may in particular consist of words, including personal names, or of designs, letters, numerals, colours, the shape, presentation or packaging of the goods, sounds or the combination of such items with each other or with colours. The requirement that a trademark must be capable of being represented graphically is not a condition for its registration. A sign may therefore be represented in any appropriate form using generally available technology. What matters is a representation that is clear, precise, self-contained, easily accessible, intelligible, durable and objective.
  • What is a design?
    A design is the appearance of a whole product or a part of it, resulting in particular from the features of the lines, contours, colours, shape, surface structure or materials of the product itself or its decoration (e.g. fabric pattern, lamp, sofa, etc.). Design is therefore visual communication and thus an important element of product and corporate identity. Creations can benefit from design protection if they fulfil the following conditions: Innovative Individual They are neither unlawful nor offensive in nature
  • Who monitors my trademark or design?
    The monitoring of your trademark with regard to a possible infringement by copying or similarity etc. is not carried out by a governmental agency, it is the responsibility of the trademark owner. Appointing a legal representative as a precaution when registering a trademark is free and ensures a quick and competent intervention should you come across an infringement of your trademark right at a later stage. Patra monitors the term of protection of your trademark or design and informs you in due time about the upcoming renewal.
  • Who can support me with advice in the event of problems relating to trademarks or designs?
    Patra supports you in questions concerning the registration, adaptation, renewal or cancellation of your trademark or design. Should more complex legal questions arise, Patra will consult with a competent lawyer who has the appropriate experience and authority.
  • Who registers the trademark or design with the responsible trademark office?
    After consultation regarding the trademark application and with your consent, we register the trademark or design with the responsible trademark office on your behalf. We take over the entire application process and the correspondence with the relevant trademark office.
  • What is the role of the Service Agent in Liechtenstein?
    Patra is registered as Service Agent in Liechtenstein for your trademarks. We immediately forward all incoming correspondence received in relation to your trademark or design to you or your legal representatives and coordinate communication with the national trademark office if necessary.
